The law of March 2, 2022 aims to democratize sport in France, in particular by facilitating health sport and access for associations to school sports equipment. It also provides for the renewal of governing bodies, with gender parity in sports federations and the limitation of the number of terms of office of presidents. This law also tends to protect the economic model of sport.
The objective of democratizing sport in France is articulated in three parts in the law of March 2, 2022: development of sports practice for the greatest number, renewal of the governance of federations, and consolidation of the economic model of sport.
Development of sports practice
The development of sports practice for the greatest number is based in particular on health sport, which has become a mission of general interest in medical and social establishments and services, with adapted activities and a designated referent.
The prescription of sport by health professionals (doctors and physiotherapists for the renewal of prescriptions) is extended to chronic diseases (diabetes, heart disease, cancer, etc.) and to people with risk factors (hypertension, obesity, etc.) . Previously, this prescription was reserved for patients with long-term illnesses (ALD).
The sports-health centers, specifically dedicated to a more therapeutic practice of sport will receive administrative authorization, according to specifications to be defined by decree.
In primary school, sport will become daily, and special attention will be paid to familiarization with aquatic activities.
Access to school facilities should be provided for sports associations in new buildings, or in those undergoing major renovation. Associations and educational establishments will be able to use sports equipment belonging to the State or its public establishments. Municipalities and intermunicipalities will be able to establish a local sports plan.
Governance of sports federations
The governing bodies of national sports federations must respect gender parity when renewing their mandates from January 1, 2024. This parity will be extended to regional federations from January 1, 2028. The same president may not exercise more three terms at the head of a federation.
An ethics committee is established in the federations, which will be responsible in particular for ensuring the financial transparency of the leaders. The fight against discrimination is also reinforced.
The participation of top athletes in these bodies is organised, as is their professional retraining.
Sports business model
The law clarifies and reinforces the role of the national platform for the fight against rigged sports betting, which has existed since 2016. The judicial blocking of illegal sites is replaced by an administrative decision of the National Gaming Authority.
Finally, after authorization from the federation on which it depends, a professional league may create a commercial company, which it must control at least 80% of the capital, and which will be responsible for managing sports rights, excluding betting rights.
